Rules for THE SCRATCHCARD

Article 1 - Organization and Purpose of the Game: Jacquemus (hereinafter the “Organizer”), limited liability corporation with sole shareholder (“société par actions simplifiée à associé unique”) duly organized and existing under the laws of France, with a capital of €74,787.00, whose registered office is located at 69, rue de Monceau, 75008, Paris, France, registered in the Paris Trade and Companies Register under the identification number 793 555 368, is organizing a promotional lottery game entitled “THE SCRATCHCARD” / “LE TICKET” (hereinafter the “Game”).

 

The Organizer guarantees to the Participants the existence of the Prizes being offered, its complete impartiality with regard to the Game’s progress, and to apply, within the limits of its means, strict equality of opportunity between all Participants.

 

Article 2 - Conditions of participation: The Game is open to any natural person above 18 years of age living in metropolitan France or abroad who has received a scratchcard under the conditions set out below (hereinafter the “Participant”).

 

The Organizer’s staff and their spouses may not take part in the Game. Their ascendants and descendants are authorized to take part in the Game.

 

Any participation in the Game implies having read and accepted these general rules (hereinafter the “Rules”) pursuant to the provisions of article 10, being specified that scratching the card constitutes acceptance of said Rules.

 

Article 3 - Principle and Terms and Conditions of the Game: The Game is open only to customers of the Organizer who have made a purchase of at least €450.00 in value or its equivalent in the currency used for the purchase on the Organizer’s website “jacquemus.com” or at the Organizer’s store located at 58, avenue Montaigne, 75008 Paris, France, during the Promotional Period mentioned below.

 

For each purchase made on the Organizer’s website “jacquemus.com” or in the store located at 58, avenue Montaigne, 75008 Paris, France, during the Promotional Period mentioned below, the Participant will receive a scratchcard. This card may offer a chance to win a Prize under the conditions set out in article 5. Cards are distributed to Participants within the limit of the available number of cards and Prizes.

 

Each winning card has a unique, personal and strictly confidential code which shall not be shared except for the purpose of a request for collection of the Prize. Not all cards are winning cards. The Participant scratches the card received in exchange for his/her purchase to find out whether he/she has won a Prize or lost. The card will immediately indicate, below the scratching area, the Prize won by the Participant or the fact of having lost (“Try Again”). The winning card also indicates the nature of the Prize won by the Participant.

 

In the event a Prize is won, the Participant must follow the Prizes collection process provided on the back of the card and reproduced in article 6 below.

 

Article 4 - Duration of the Game: The Game runs from December 5, 2024 until for as long as stocks of available cards and Prizes last (hereinafter, the “Promotional Period”), up to a limit of ten thousand (10,000) cards and fifty-six (56) Prizes available.

 

The cards and prizes available are distributed as follows: nine thousand five hundred (9500) cards including fifty-one (51) winning cards for online purchases and five hundred (500) cards including five (5) winning cards for purchases at the Montaigne store.

 

The Organizer reserves the right to modify, extend, suspend, shorten or cancel the Promotional Period if circumstances so require, without incurring any liability in this respect.

 

Article 5 - Prizes: The Prizes of the Game will be among eight (8) products selected by the Organizer from the Organizer’s Winter 2024 collection, with a unit value ranging from €85.00 to €1,090.00, (hereinafter, the “Prize (s)”) and within the limit of fifty-six (56) Prizes available.

 

The available Prizes are the following:

 

-       5 “Rond Carré Off-White” moumoute clutchbags including 1 available in the Montaigne store and 4 available online;

-       5 “Petit Bisou” bags with silver chain including 1 available in the Montaigne store and 4 available online;

-       5 mini red scarfs including 1 available in the Montaigne store and 4 available online;

-       5 Hats with the Organizer’s logo including 1 available in the Montaigne store and 4 available online;

-       10 mohair masks “Nuvola” Off-white including 1 available in the Montaigne store and 9 available online;

-       10 Mikado games only available online;

-       11 hot-water Off-White bottles only available online;

-       5 yoyos “rond carré” only available online.

 

The Prizes are awarded randomly via the pre-established winning scratchcards and cannot be exchanged, reimbursed or transferred.

 

In the event of stock shortage, the Organizer reserves the right to replace the Prize with an item of equivalent value

 

Article 6 – Collecting conditions of the Prizes: Winners are invited to follow the following collection process:

 

-       In the event of a purchase in the Montaigne store: the Participant has one (1) month from the date of the in-store purchase to request the Prize from the Organizer at the email address leticket@jacquemus.com. The collection request must be sent with a copy of the receipt associated with the winning card and a shipping address; or

-       In the event of an online purchase, the Participant has one (1) month from the date of the receipt of the order to request the Prize from the Organizer at the email address: leticket@jacquemus.com. The collection request must be sent from the email address used to make the purchase and must specify the order number associated with the card.

 

On expiry of the one (1) month period from the date of the in-store purchase or the date of the receipt of the order, the Prize will be considered lost.

 

The Prizes will be shipped to the winning Participants within forty-five (45) days from the request for collection.

 

The Organizer reserves the right to carry out any checks to ensure compliance with these Rules, in particular to exclude any Participant who has committed any form of abuse or attempted fraud.

 

Returning of products shall cause the winning Participant to forfeit its Prizes, if any.

 

Article 7 - Limitation of liability: The Organizer declines and waives any and all liability in the event of error, loss, theft or damage to cards after they have been distributed.

 

The Participant expressly acknowledges that he/she participates in the Game at his/her own risk and under his/her sole responsibility.

 

Under no circumstances may the Organizer be held liable for:

 

-       Any direct or indirect damage, in particular with regard to loss of profits, loss of earnings, loss of customers, loss of data, etc., which may result from the playing the Game or, from the impossibility of playing it;

-       Malfunction, unavailability of access, misuse, incorrect configuration of the Participant's devices, or the use of a device that is not commonly used or that is obsolete by the Participant in case of online participation;

-       The content of advertisements and other external links or sources accessible by the Participant from the Game, where applicable;

-       Any technical unavailability of the connection, whether this is due in particular to a case of force majeure, maintenance, updating, modification, intervention by the host, an internal or external strike, a network failure, a power cut or incorrect configuration or use of the Participant's devices.

 

The Participant shall be liable for any damage, including direct, indirect, consequential, special or incidental, physical and/or moral, material and/or immaterial damage, that he/she may cause to the other Participants, the Organizer, or to third parties by participating in the Game.

 

Article 8 – Exclusion: The Organizer reserves the right to exclude any person in breach of these Rules without prior notice and to prevent their participation in the Game. Any Participant using prohibited means of participation (hacking tools, viruses, Trojan horses, etc.) will be excluded. Groups of players, automated services or professional services are not authorized to take part in the Game.

 

Article 9 - Personal Data Protection: The personal data collected in the context of the Game is processed in accordance with the applicable regulations and in particular the amended French Data Protection Act of 6 January 1978 and the General Data Protection Regulation (Regulation (EU) 2016/679) of the European Parliament and of the Council of 27 April 2016 (GDPR).

 

The Organizer is required to use personal data in the context of the Game to enable participation in the Game, and in particular for the allocation and presentation of the cards at the time of purchase online or in-store. In this context, the processing is based on the contractual obligation linked to the use of the service (art. 6 para. 1 b of the GDPR).

 

On request, the Organizer may provide the Participant with the information required under Article 15 of the GDPR. More specifically, in accordance with the applicable provisions, the Participant has the right to request the correction of erroneous data, and to limit its processing or transmission. In addition, the Participant has the right to lodge a complaint with the supervisory authority. Article 10 - Acceptance of the Rules: Participation in the Game implies acceptance of these Rules. They can be reviewed when participating in the Game online or in-store at the time of purchase.

 

The Organizer has set up these Rules in application of French law and Directive 2005/29/EC of the European Parliament and of the Council of 11 May 2005.

 

Article 11 - Applicable law and disputes: These Rules are subject to French law. Any dispute or claim relating to the Game must be made in writing and addressed to the Organizer, within thirty (30) days of the end of the Game.

 

Any practical difficulty in applying or interpreting these Rules will be decided by the Organizer.

 

In the event of a dispute that cannot be resolved amicably, the competent courts will be those within the jurisdiction of the Paris Court of Appeal.
